Terms & Conditions — Ipswich Mini Diggers
These terms apply to services supplied by Ipswich Mini Diggers. By accepting a quote or confirming a booking, the customer agrees to these terms.
Quotes and Charges
All work will be charged according to the written quote or agreed hourly rates provided to the customer. The quote will show GST and the total amount payable.
Quotes are based on the job details, photographs, access information and site conditions disclosed by the customer. If the scope or site conditions differ, we will discuss any additional work or charges with the customer before continuing.
Hire Conditions
A minimum three-hour hire applies unless otherwise stated in writing.
There is no travel-time charge within 15 km of our yard. Travel outside of this radius will incur a 1 hour charge.
Machinery attachments and additional services will only be charged when agreed upon or included in the accepted quote.
Site Access and Preparation
The customer must provide safe and suitable access for our machinery, operators and vehicles. The customer must disclose gates, narrow access points, soft ground, overhead obstructions and any other conditions that may affect the work.
The customer must advise us of all known underground pipes, electrical cables, drainage, irrigation, septic systems and private services. Ipswich Mini Diggers may delay or stop work if underground services cannot be safely identified.
Unexpected Site Conditions
Rock, buried concrete, large roots, unstable ground, water, contaminated soil, asbestos, undisclosed services or other unexpected conditions may affect the time, machinery or attachments required.
If unexpected conditions arise, we will explain the situation and obtain the customer’s approval before completing additional chargeable work, unless immediate action is reasonably necessary to make the site safe.
Excavated Material and Disposal
Excavated material will remain onsite unless removal is included in the accepted quote. Disposal costs, tipping fees and additional truck movements may be charged when agreed with the customer.
Weather and Delays
Work may be postponed or stopped because of unsafe weather, wet ground, machinery issues, site hazards or circumstances outside our reasonable control. We will contact the customer and arrange another suitable time where required.
Cancellations
Please provide at least 24 hours’ notice when cancelling or rescheduling a booking.
A cancellation made with less than 24 hours’ notice may incur the minimum hire charge where Ipswich Mini Diggers has reasonably incurred costs or lost the booked work period.
Payment
Payment is due by the date shown on the invoice.
Safety
Our operators remain responsible for the safe operation of our machinery. Customers and other people onsite must remain outside the designated work area and follow reasonable safety directions.
We may stop work if the site becomes unsafe or if continuing could place people, property or equipment at risk.
Damage and Existing Conditions
Ipswich Mini Diggers will take reasonable care while completing the work. We are not responsible for damage caused by inaccurate or undisclosed information, unidentified private services, pre-existing defects or site conditions outside our reasonable control.
Australian Consumer Law
Nothing in these terms excludes or restricts any rights or guarantees that cannot legally be excluded under the Australian Consumer Law.
Concerns and Disputes
If you have a concern about our work or an invoice, please contact us promptly so we can attempt to resolve the matter fairly and in good faith.
